1. General Terms

Welcome to Nick Bodoin's official art store. By accessing and placing an order with Nick Bodoin, you confirm that you are in agreement with and bound by the terms and conditions contained in these Terms & Conditions.

These terms apply to the entire website and any email or other type of communication between you and Nick Bodoin. Under no circumstances shall Nick Bodoin be liable for any direct, indirect, special, incidental or consequential damages, including, but not limited to, loss of data or profit, arising out of the use, or the inability to use, the materials on this site.

2. Artwork Purchases

2.1 Pricing and Payment

• All prices are listed in Canadian Dollars (CAD) unless otherwise specified.
• Prices are subject to change without notice.
• Payment must be received in full before artwork is shipped.
• We accept major credit cards, PayPal, and bank transfers for high-value purchases.

2.2 Availability

All original artworks are one-of-a-kind pieces. Once sold, the listing will be marked as unavailable. We make every effort to display accurate availability information on our website.

3. Commissions

3.1 Commission Process

• All commissions require an initial consultation to discuss concept, size, materials, and timeline.
• A 50% non-refundable deposit is required to begin work on commissioned pieces.
• The remaining 50% is due upon completion, before shipping.
• Estimated completion times are provided in good faith but are not guaranteed.

3.2 Commission Terms

Once a commission is accepted and the deposit is paid, the client agrees to the proposed concept, size, and price. Minor adjustments may be made during the creation process with mutual agreement. The artist reserves creative freedom in the execution of commissioned works.

4. Intellectual Property

4.1 Copyright

All artwork, images, designs, and content on this website are the intellectual property of Nick Bodoin and are protected by international copyright laws. The purchase of an artwork grants the buyer ownership of the physical piece only, not the copyright or reproduction rights.

4.2 Reproduction Rights

• The artist retains all reproduction rights to commissioned and purchased artwork.
• Buyers may not reproduce, photograph for commercial use, or create derivatives of purchased artwork without written permission.
• The artist reserves the right to photograph artwork for portfolio, exhibition, and promotional purposes.

5. Shipping & Delivery

• Shipping times are estimates and not guaranteed.
• All artwork is fully insured during transit.
• International buyers are responsible for customs fees and import duties.

6. Authenticity & Certificates

All original artworks come with a signed Certificate of Authenticity that includes:

• Artwork title and creation date
• Medium and dimensions
• Artist signature and date
• Unique artwork identification number

7. Limitation of Liability

Nick Bodoin shall not be liable for any special, indirect, incidental, or consequential damages arising out of or related to this agreement or the artwork purchased, including but not limited to loss of profits, loss of data, or business interruption.

8. Modifications to Terms

Nick Bodoin reserves the right to modify these Terms & Conditions at any time. Changes will be effective immediately upon posting to the website. Continued use of the website after changes constitutes acceptance of the modified terms.

9. Governing Law

These Terms & Conditions are governed by and construed in accordance with the laws of the Province of Quebec, Canada. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Quebec.
